Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website, web application, and related services (collectively, the "Service") provided by ThreeD ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Account" means the account you create to access the Service.
- "Content" means any data, text, files, or materials you upload, submit, or generate through the Service.
- "User", "you", or "your" means the individual or entity using the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Accounts and Registration
3.1. To use certain features, you must register for an Account and provide accurate, current, and complete information, including valid login credentials.
3.2. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
3.3. You agree to notify us immediately at help@trythreed.com of any unauthorized use of your Account or any other breach of security.
3.4. We reserve the right to suspend or terminate Accounts that contain false information or that are used in violation of these Terms.
4. Fees and Payment
4.1. Access to the paid features of the Service is provided for a one-time payment, not a recurring subscription, unless we clearly state otherwise at the point of purchase. Pricing is described at the point of purchase.
4.2. Payments are processed by Stripe, our third-party payment processor. By providing payment details, you authorize us and Stripe to charge the applicable fee to your selected payment method. We do not receive or store your full card details; we store only the minimal information needed to recognize you as a paid user.
4.3. Subject to your rights under the Australian Consumer Law (see Section 10) and any other non-excludable law, fees are otherwise non-refundable. We may also, at our discretion, offer a voluntary refund within 14 days of purchase.
4.4. We may change our fees from time to time. A change will not affect a purchase you have already made.
4.5. You are responsible for any applicable taxes, except for taxes based on our net income.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Upload or transmit malware, or otherwise interfere with or disrupt the Service;
- Attempt to gain unauthorized access to the Service, other Accounts, or our systems or networks;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
- Resell, rent, sublicense, or transfer your license or access to the Service to anyone else without our written permission (this does not restrict your use of Output you create, which is covered by Section 6);
- Use the Service to infringe the intellectual property or privacy rights of others;
- Scrape, harvest, or use automated means to access the Service in a manner that exceeds reasonable use.
6. Your Content
6.1. You retain all ownership rights to your Content.
6.2. Your Content is processed locally on your own device and is not uploaded to or stored on our servers. We do not access your Content unless you choose to send it to us (for example, as part of a support request), in which case we use it only to respond to your request. We therefore do not require, and you do not grant us, a license to your Content beyond what is necessary to operate the Service on your device.
6.3. You represent and warrant that you have all rights necessary to use your Content and that it does not violate these Terms or any third-party rights.
6.4. Exported output. Images, renders, models, videos, and other assets you generate and export from the Service (collectively, "Output") are yours to use, including for commercial purposes, subject to these Terms. You are solely responsible for the Output and for any Content you incorporate into it (such as artwork, logos, photographs, or text you upload or apply).
6.5. Third-party rights in Output. Some designs may depict, or be combined with, real-world products, brands, logos, or trademarks. Whether and how you may use such material is governed by the laws of your country and by third-party rights, and is your responsibility. We make no representation that any particular use of the Output is lawful, and we recommend you confirm you hold the necessary rights before publishing or distributing it.
7. Intellectual Property
7.1. The Service, including all software, designs, text, graphics, and trademarks, is owned by us or our licensors and is protected by intellectual property laws.
7.2. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
7.3. All rights not expressly granted to you are reserved by us.
8. Third-Party Services
The Service may integrate with or link to third-party services (such as payment processors and analytics providers). We are not responsible for the content, policies, or practices of any third-party services. Your use of such services is governed by their own terms.
9. Termination
9.1. You may stop using the Service and delete your Account at any time.
9.2. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue the Service.
9.3. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
10. Australian Consumer Law
10.1. If you are a consumer in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law where to do so would be unlawful.
10.2. For major failures with the Service you are entitled to the remedies provided by the Australian Consumer Law, and to compensation for any other reasonably foreseeable loss or damage. For failures that do not amount to a major failure, you are entitled to have the failure rectified within a reasonable time, and if this is not done, to a refund.
10.3. To the extent the Service is not a "consumer" supply under the Australian Consumer Law, our liability for breach of a non-excludable guarantee is limited, at our option, to resupplying the Service or paying the cost of having it resupplied.
11. Disclaimer of Warranties
SUBJECT TO SECTION 10 AND ANY RIGHTS YOU HAVE UNDER APPLICABLE LAW THAT CANNOT BE EXCLUDED, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
SUBJECT TO SECTION 10 AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THREED OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US. NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.
13. Indemnification
Subject to your rights under the Australian Consumer Law and any other law that cannot be excluded, you agree to indemnify and hold harmless ThreeD and its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Content or Output, or your violation of these Terms.
14. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of NSW, Australia, without regard to its conflict-of-laws principles. You and we submit to the non-exclusive jurisdiction of the courts of NSW, Australia. This choice of law and jurisdiction does not deprive you of the protection of any mandatory consumer laws of the country in which you reside.
